Products
Certain products or services may be available exclusively online through the website. These products may have limited quantities and are subject to return or exchange only according to our Returns Policy.
We have made every effort to display as accurately as possible the colours and images of our products that appear on this website. We cannot guarantee that your computer monitor's display of any colour will be accurate.
We reserve the right, but are not obligated, to limit the sale of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by- case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
Price of Products
The prices of the Products will be as quoted on our site. We use our best efforts to ensure that the prices of Products are correct at the time when the relevant information was entered onto the system.
Prices for our Products may change from time to time, but changes will not affect any order which we have confirmed with a Dispatch Confirmation.
Simon Griffiths Sculpture Ltd is not currently required to charge VAT. The price of a Product includes delivery charges to the UK.
It is always possible that, despite our reasonable efforts some of the Products on our site may be incorrectly priced. If we discover an error in the price of the Products you have ordered we will inform you of this error and we will give you the option of continuing to purchase the Product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing.
Please note that if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing, we do not have to provide the Products to you at the incorrect (lower) price.
Payments
We accept payments through Stripe
All payment information is transmitted over secure SSL encryption and is not stored by us.
Cancellation
You will have a right to cancel an order within 7 working days from the date that you receive the Goods. Cancellation must be confirmed to us by notice in writing.
You must take reasonable care of all Goods in your possession and return them to us, appropriately packaged to avoid damage, within 7 days from the cancellation date. We require that all goods returned to us are sent by insured delivery. We reserve the right to arrange collection, in which case you will be responsible for return charges. No refund of any payments made in relation to the goods returned will be made until they are back in our possession.
We will refund the purchase price to you within 30 days of the cancellation notice but we reserve the right to charge a restocking fee and any other costs we incur in connection with the return of the Goods.
In the case of Goods which are made and supplied to your specification or which have been personalised for you, you will not have the right to cancel the Contract.
Returns and Refunds
We hope you love your sculpture as much as we do! However ,If you do want to return your item please e-mail us at s.griffithssculpture@icloud.com as soon as possible. Please ensure your item arrives safely back to us within 14 days of receipt for UK returns. You'll need to use a trackable mail service with insurance and pay the postage charge. Please note that we cannot be held responsible for any loss or damage of your returned item.
We will offer a full refund minus delivery costs, to your payment account, within 7 working days of receipt of the undamaged returned item.
Commissioned items are non-refundable.
All items must be returned in a perfect condition.
Please make sure you return them in the same packaging, otherwise we cannot accept the return from you.
International Returns Customers
Please use a reputable international courier service which ensures that your parcel is tracked and insured as we cannot be held responsible for any loss or damage. Remember that when returning goods you must complete a pro-forma invoice (usually provided by your chosen courier) clearly stating that your return parcel is 'British Return Goods' with a domestic sales value of £0.00. This will ensure that your returned items are not applicable to duty once they reach the UK.
If your package is not clearly marked and duty must be paid before release of your return parcel from customs it is regrettable that Simon Griffiths Sculpture Ltd will refuse delivery. Please contact us at s.griffithssculpture@icloud.com if you need any assistance with the above.
Risk and Ownership
The risk of loss or damage to Goods passes to you upon delivery.
Ownership in all Goods remains with us until full payment of all amounts due to us has been received from you.
You will be responsible for the safe custody and insurance of all Goods in your possession. You have no right to re-sell any Goods until payment has been received in full by us.
Privacy Policy
We are keen to protect your privacy while shopping online. We will use the information you provide lawfully (in accordance with the Data Protection Act 1998). The information we will collect about you when you place an order includes: Your Name, Address, Phone Number, Email Address. This is to enable us to process your order and keep you informed of the orders progress.
Card information is transmitted over secure SSL encryption and is not stored.
Accuracy of Information
While every care is taken to ensure that all information on this website is correct, there may still be errors or omissions. If you find an error or omission please let us know by emailing s.griffithssculpture@icloud.com and we will correct it as soon as possible after verification.
We apologise for any inconvenience that may be caused, but we cannot always offer the exact described product at the specified price, if errors and/or omissions are present. In the event of human error or malfunction in the technology, the prices on the site do not commit us to sale.
Disclaimer
Simon Griffiths Sculpture Ltd makes every effort to keep the site up-to-date but cannot guarantee that this site and its contents are completely free of technical errors. By using this site, you acknowledge that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with this site. We are also not liable for any damages associated with use of this site however caused. Simon Griffiths Sculpture Ltd total liability for any claim howsoever arising shall not exceed the price of the goods supplied by Simon Griffiths Sculpture Ltd to the customer, together with any postage costs incurred.
Simon Griffiths Sculpture Ltd shall not be liable for any consequential customer loss whether this arises from a breach of duty in contract or in any other way.
Liability
To the maximum extent permitted by law, Simon Griffiths Sculpture Ltd makes no representation or warranty of any kind express or implied statutory or otherwise in connection with the site or our products.
Except to the extent prohibited by law and to the maximum extent permitted by law, Simon Griffiths Sculpture Ltd will not be liable for any consequential, special or indirect losses suffered or incurred by you arising out of or in connection with the provisions of any matter under these terms and conditions.
Except to the extent prohibited by law and to the maximum extent permitted by law, Simon Griffiths Sculpture Ltd liability for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the ordered product(s).
The foregoing shall not exclude or limit any liability that may not, by applicable law, be excluded or limited.
Nothing in these terms and conditions affect your statutory rights as a consumer.
If any provision in these Terms is held by a court to be unenforceable, that will not affect the remaining provisions of the Terms.
Restrictions
We will not have any liability to you if we are prevented from performing any of our obligations on account of any circumstances beyond our reasonable control which includes, but is not limited to, extreme weather conditions, act of God, terrorism, war, strike or difficulty in obtaining materials and/or labour. In any of these circumstances we reserve the right to terminate the Contract.
Legal
This website, its contents and any contracts arising out of it are governed by English law. By entering into a contract both parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales. If any provision of these terms and conditions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable for these terms and conditions and shall not affect the validity or enforceability of any remaining provisions.

All copyright, trade marks and all other intellectual property rights in the website and its contents (including without limitation the website design, text, graphics and all software and source codes as well as the colour scheme and the layout connected with the website) are owned by or licensed to us or otherwise used by us as permitted by law.
